Waiver Form Agreement

By purchasing a ticket, you have read, understood, and voluntarily agreed to all terms outlined in the waiver below.
RISK WARNING:

PARTICIPATION IN PARKOUR AND/OR FREERUNNING ACTIVITIES IS AN INHERENTLY DANGEROUS RECREATIONAL ACTIVITY AND INVOLVES SIGNIFICANT RISK OF PARTICIPANTS SUFFERING PERSONAL INJURY INCLUDING THE POSSIBILITY OF SERIOUS INJURY, PERMANENT DISABILITY OR DEATH. ALL PARTICIPANTS WHO ENGAGE IN SUCH RECREATIONAL ACTIVITIES DO SO AT THEIR OWN RISK.
1. Supplier of Services

KongQuest provides recreational services, including but not limited to: parkour and freerunning classes, public events, equipment-based activities, and all associated design, layout, maintenance, and use of training equipment. By attending or participating in any KongQuest activity, you agree to be bound by the terms of this waiver each time you access our services, enter our premises, or engage with our equipment.
2. Acknowledgment of Risks

You acknowledge that parkour and related activities carry inherent physical risks, including the potential for serious injury, permanent disability, or death. You confirm your understanding of these risks and voluntarily accept full responsibility for your participation in all KongQuest activities.
3. Personal Responsibility

It is your responsibility to ensure that you are physically and medically fit to participate. You must inspect all equipment and surfaces for safety before use and notify your instructor of any existing injuries or limitations. Seek professional medical advice if unsure.
4. Waiver of Liability

To the fullest extent permitted by law, you release KongQuest, its directors, staff, agents, and affiliates from any liability for personal injury, property damage, loss, or death arising from your participation. This includes, but is not limited to, claims based on negligence, contract breach, or statutory duty.
5. Legal Warning

5.1 WARNING:

Under the Australian Consumer Law & Fair Trading Act 2012, you may have certain rights if services are not supplied with due care or are unfit for purpose. By signing this waiver, you acknowledge that these rights may be excluded, restricted, or modified.

5.2 NOTE:

This exclusion does not apply in cases of gross negligence by KongQuest, which refers to conduct done with reckless disregard for safety.
6. Emergency Medical Care

You authorise KongQuest to act in your best interest in the event of a medical emergency. This may include first aid, ambulance transport, or hospital admission. You agree to bear all associated costs.
7. Code of Conduct

All participants must follow staff instructions and posted safety signage at all times. KongQuest reserves the right to suspend or revoke access for non-compliance or reckless behaviour, at its sole discretion.
8. Personal Belongings

KongQuest is not responsible for the safety, loss, or theft of any personal property brought onto the premises or event site.
9. Substance Use

Consumption of alcohol or any illegal drugs before or during any KongQuest activity is strictly prohibited.
10. Media Consent

You consent to being recorded via CCTV or other means during participation. KongQuest may use images or footage for promotional purposes (e.g., website, social media, advertising) without compensation.
11. Assumption of Risk

You accept full responsibility for all physical, emotional, or financial risks resulting from your participation, including injury, illness, disability, or death.
12. Indemnification

You agree to indemnify and hold harmless KongQuest and its affiliates against any claims, legal action, or costs arising from your participation in any activity.
13. Parental Consent (if under 18)

If the participant is a minor, this waiver must be signed by a parent or legal guardian. The guardian assumes full responsibility for the minor’s conduct and must provide supervision where required.
14. Acknowledgment of Understanding

By purchasing a ticket, you acknowledge that you have read, understood, and voluntarily agreed to all terms outlined in this waiver.
