ACCIDENT WAIVER AND RELEASE OF LIABILITY AGREEMENT

1 - Supplier of Services:

KongQuest is the supplier of recreational services, including but not limited to parkour, freerunning, classes in parkour, classes in freerunning, parkour events, freerunning events, training equipment maintenance, the condition, layout, construction, design, maintenance, and use of the equipment, and any other associated sporting activities, to you (the customer). By agreeing to participate, engage in, or use our products, you agree to be bound by these conditions each time you enter the premises and participate in the recreational activities or use our products.

2 - Acknowledgment of Risks:

By entering the event run by KongQuest, you acknowledge and agree that participation in parkour involves inherent risks that may cause injuries or may result in death or serious disability. You acknowledge that parkour can be physically strenuous. You acknowledge and agree that your participation in classes is absolutely at your own risk, with full knowledge and appreciation of the nature and extent of all risks involved.

3- Personal Responsibility:

You are responsible for ensuring that you are physically and medically fit to participate in classes or open sessions. You understand that it is your responsibility to check all equipment and/or surfaces before undertaking any training to ensure your personal safety. You are responsible for your own personal safety and must inform your instructor of any physical limitations or injuries you have prior to class. If in doubt, please seek medical advice.

4 - Waiver of Liability:

KongQuest is not responsible for any personal injury, property loss, or death while on the premises, whether caused by negligence or otherwise. To the full extent permitted by law, you waive all of your legal rights against KongQuest and fully release KongQuest from any loss, damages, injury, or death arising out of or in relation to your participation in the activities conducted or organised by the company, including without limitation, liability for any negligent or tortious act or omission, breach of duty, breach of contract, or breach of statutory duty on the part of the company, its office bearers, directors, employees, or agents.

5 - Legal Warning:

5.1 - WARNING: If you participate in these activities, your rights to sue KongQuest under the Australian Consumer Law & Fair Trading Act 2012 if you are killed or injured because the activities were not supplied with due care and skill or were not reasonably fit for their purpose, are excluded, restricted, or modified in the way set out in this document.

5.2 - NOTE: The change to your rights, as set out in this document, does not apply if your death or injury is due to gross negligence on the supplier’s part. Gross negligence, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer Law & Fair Trading Regulations 2012 and section 23(3)(b) of the Australian Consumer Law & Fair Trading Act 2012.

6 - Emergency Actions:

You agree to pay the cost of and authorise KongQuest to take all steps it considers reasonably necessary to protect your welfare in the event of personal injury, including the administration of any emergency medical treatment and ambulance transportation.

7 - Compliance and Conduct:

The customer and all participants must comply with all signs or other directions of KongQuest. KongQuest may suspend or cancel the customer’s and a participant’s access to recreational activities at any KongQuest venue at its absolute discretion for non-compliance with these conditions, or for reckless or careless conduct.

8 - Personal Belongings:

By entering the event space, you acknowledge and agree that KongQuest takes no responsibility for the storage and safekeeping of your personal belongings while you attend class or are on the premises. KongQuest takes no responsibility for lost or stolen property.

9 - Substance Use:

You agree not to drink alcohol or take drugs prohibited by law before or during any KongQuest classes, open sessions, or events conducted or organised by KongQuest, or on KongQuest premises at any time.

10 - Photography and Videography Consent:

I give consent for my image to be recorded at KongQuest on CCTV or other devices. Images of participants at KongQuest may be used without compensation on the company website, social media, or any promotional material produced and/or published by KongQuest.

11 - Assumption of Risk:

By participating in the activities, you acknowledge and willingly assume all risks associated with these activities, including the risk of physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability, economic or emotional loss, and death.

12 - Indemnification:

You agree to indemnify, defend, and hold harmless KongQuest from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from or related to your participation in the activities.

13 - Parental Consent (if applicable):

If the participant is a minor, a parent or legal guardian must provide consent and agree to the terms of this waiver on behalf of the minor.

14 - Acknowledgment of Understanding:

By submitting your detials in the from on this site, you acknowledge that you have read and fully understand this agreement and that you are signing it voluntarily.
